Terms of sale and use
The rules that apply between you and the publisher of Calenday, for the free plan and for the Lifetime licence.
1. Purpose
These terms govern access to and use of the Calenday service, published by PUBLISHER LEGAL NAME, and the purchase of the Lifetime licence. Creating an account implies unreserved acceptance of them.
2. The service
Calenday is an online appointment scheduling service. It allows a user to publish booking pages, connect calendars, define availability rules, receive bookings, and — with the Lifetime licence — send automated workflows, collect payment for bookings, generate video conferencing links and access analytics.
The service is offered in two plans:
- Free — no charge, no time limit, including unlimited brands, event types and bookings.
- Lifetime — a one-off payment of 99 US dollars excluding tax, covering an unlimited number of users within the purchasing account, with no expiry and no renewal.
3. Account
Creating an account requires a valid email address. You are responsible for the accuracy of the information supplied, for the confidentiality of your credentials, and for all activity carried out through your account. Enabling two-factor authentication is strongly recommended.
An account may be used by several people within the same organisation. It may not be shared between separate legal entities in order to circumvent the licence.
4. Price and payment
The Lifetime licence costs 99 US dollars excluding tax, paid once. Applicable VAT or sales tax is calculated at checkout according to your country and, for businesses, your VAT number.
Payment is processed by Stripe. Calenday neither receives nor stores your card details. The licence is activated once Stripe confirms the payment.
A change in the public price does not affect licences already purchased.
5. Right of withdrawal
Where you are a consumer within the meaning of consumer law, you have fourteen days from purchase to withdraw, without giving a reason, by writing to [email protected].
By requesting immediate access to the Lifetime features, you expressly ask for performance to begin before the end of that period and acknowledge that you lose your right of withdrawal once the service has been fully performed, in accordance with the applicable provisions on the supply of digital content.
Outside that framework, a refund may be granted at the publisher's discretion within fourteen days of purchase. The free plan, which has no time limit and no booking cap, is intended to allow full evaluation before any payment.
6. Your obligations
You undertake not to use Calenday to send unsolicited communications, to host or distribute illegal content, to attempt to circumvent the technical limits of the service, to place a disproportionate load on the infrastructure, or to infringe the rights of others.
You are solely responsible for the content you publish on your booking pages, for the personal data of the invitees you collect, and for compliance with the rules applicable to your own business.
7. Availability
The publisher applies reasonable efforts to keep the service available, without guaranteeing uninterrupted availability. Scheduled maintenance is announced in advance where it is likely to interrupt the service.
No uptime commitment or service level agreement is attached to the free plan or to the Lifetime licence. Where such a commitment is contractually required, it must be the subject of a separate agreement.
8. Payments you collect
Where you enable payment collection for your bookings, the funds are paid by your client into your own Stripe or PayPal account, through a connection you establish yourself. The publisher is a technical intermediary and is at no point the recipient of those funds.
You are responsible for your relationship with your payment provider, for your own terms of sale towards your clients, and for the tax treatment of the sums you collect.
9. Liability
The publisher's liability is limited to direct and foreseeable damage, and may not exceed the amount paid for the Lifetime licence. The publisher is not liable for indirect damage, in particular loss of turnover, loss of opportunity, loss of data attributable to the user, or damage caused by a third-party service on which the user depends.
No liability is accepted for a booking that fails to complete because of an interruption at Google, Microsoft, Zoom, Stripe or PayPal.
10. Suspension and termination
You may delete your account at any time from the settings screen. Deletion is definitive and removes your data within thirty days.
The publisher may suspend an account that breaches these terms, after notice except where the breach is serious or manifestly unlawful.
Termination of the free plan does not give rise to any refund. Termination of a Lifetime licence at the publisher's initiative for reasons unrelated to a breach gives rise to a refund pro rata to a three-year notional term.
11. Self-hosting
The Lifetime licence includes the right to deploy Calenday on infrastructure you control, for your own use. It does not include the right to redistribute the software, to resell it, or to operate it as a service for third parties.
12. Changes
These terms may be amended. Account holders are informed by email at least fifteen days before any material change takes effect. Continuing to use the service after that date constitutes acceptance.
13. Applicable law
These terms are governed by APPLICABLE LAW. In the absence of an amicable settlement, disputes fall within the jurisdiction of COMPETENT COURT, subject to the mandatory rules protecting consumers.
